Terms of use

These terms apply to the use of the VYKA platform, operated by Novigo Tecnologia. By creating an account or using the service, you agree to the conditions below. Please also read the Privacy policy.

What the platform is

VYKA is a technology platform that connects patients and health professionals for video care, with scheduling, documents and history. Health care is provided by the professional or institution that treats you. VYKA does not provide health services and does not replace a professional's assessment.

Urgent and emergency care

A video consultation does not replace urgent or emergency care. If life is at risk, go immediately to an in-person health service or call SAMU (192).

Telehealth and professional rules

Video care follows Law No. 14,510/2022 (telehealth) and the rules of each professional council. In Medicine, CFM Resolution No. 2,314/2022 regulates telemedicine. The professional assesses, case by case, whether a video consultation is appropriate and may recommend in-person care when necessary.

Registration and access

• To use the platform you must be 18 or older, or be represented by a legal guardian.
• Registration information must be true and up to date.
• Access is personal and uses a one-time code sent to you. Do not share the code with anyone.
• You are responsible for what happens in your account while it is in use by you or by anyone you authorize.

Booking, rescheduling and cancellation

You can book, reschedule or cancel from your area. Do so in advance so someone else can use the slot. The specific rules of each professional or institution, including no-shows and charges, apply on top of these general conditions and will be shown before confirmation.

Fees and payment

For private care, the consultation fee is set by the professional and shown to you before confirmation. For care linked to a consortium, a city hall or a company, the subsidy and patient contribution rules in the institution's contract apply. The rights under the Consumer Protection Code (Law No. 8,078/1990) and the e-commerce information rules (Decree No. 7,962/2013) remain guaranteed.

The video consultation

To take part you need an internet connection, camera and microphone. Choose a private, quiet place. Recording, photographing or sharing the consultation without the authorization of all participants is not allowed. Connection quality also depends on your network and device.

Documents

Prescriptions, certificates, reports and other documents are issued by the professional, who is responsible for their content and for following the rules of their profession, including those on electronic signature and validity, such as Law No. 14,063/2020 and Provisional Measure No. 2,200-2/2001, where applicable.

Conduct and proper use

Treat professionals and other users with respect. It is not allowed to:

• provide false information or use someone else's account;
• try to access areas or data that are not yours, or test security flaws without authorization;
• use the platform for unlawful purposes, spam or to send offensive content;
• copy or resell the service without authorization.

Responsibilities

The professional is responsible for the care provided. Under the Consumer Protection Code, the personal liability of liberal professionals is determined by verifying fault (art. 14, para. 4).

VYKA is responsible for the technology that enables care and works to keep the service available, but does not guarantee uninterrupted operation, and there may be interruptions for maintenance or for reasons beyond our control. Nothing in these terms excludes liabilities that the law does not allow to be excluded.

Propriedade intelectual

The VYKA brand, the software, the texts and the other content on the platform belong to Novigo Tecnologia or its licensors. You receive a personal, limited and revocable license to use the service under these terms.

Suspension and termination

You can stop using the platform and ask for your account to be deleted at any time. We may suspend or end access in case of breach of these terms, suspected fraud or legal requirement, notifying you whenever possible.

Privacidade

Personal data is processed according to the Privacy policy, in accordance with the LGPD (Law No. 13,709/2018).

Changes to the terms

These terms may be updated. Relevant changes will be communicated, and the date of the last update appears at the top of this page. Continuing to use the service after a change means you agree to the new text.

Governing law and forum

These terms follow the laws of Brazil. For consumers, the forum of their place of residence is guaranteed.
